Triple Surge Guard Service Agreement

By ordering and receiving installation of EnergyUnited's Triple Surge Guard Service, as defined herein, the "Customer" (owner of the dwelling to which the surge protector(s) is affixed and person responsible for paying the utility bill) and EnergyUnited (EU), agree to the following terms:

1. You will allow an authorized EU contractor/representative to install (one) surge protector at the electrical entrance to the residence, (one) surge protector for the telephone entrance to the residence and (one) surge protector for the cable/satellite TV entrance to the residence (hereinafter, "Triple Surge Guard Service"). The equipment will be installed in accordance with the standards outlined by TESCO, the equipment manufacturer.

 

2. You will receive free installation (for a limited time) for the Triple Surge Guard Service equipment on your residence and will pay a monthly service fee. All charges will be added to your EnergyUnited monthly bill. Surge protectors for additional telephone and/or cable/satellite TV lines will be billed at an extra $1.50 per line per month. All surge protectors remain the property of EU.

3. The Agreement is effective on the date the equipment is installed on your residence and will continue in effect for a minimum of 24 months. If you cancel this Agreement before the completion of the 24-month term, for reasons other than moving , you agree to pay a $50 cancellation fee, which will appear on your final EnergyUnited bill.

After the initial 24-month agreement, service and lease will continue until either you or EU cancels the Agreement. The cancellation date is effective the day EU receives notice from you. Cancellation of the Agreement by either you or EU shall be without prejudice to the rights or remedies of either party under the Agreement.

4. You are responsible for paying your monthly service fees under the same terms of your utility bill. If your account becomes 60 days delinquent, you will receive written notification that your Triple Surge Guard Service will be canceled and the equipment removed from your residence. You will still be responsible for any past due balances. If removal occurs within your initial 24-month term, you agree to pay the $50 cancellation and equipment removal fee.

5. The warranty provided under EU's Triple Surge Guard Service is a manufacturer's product warranty offered by TESCO, and is passed on to you. EU does not pay claims. Highlights of the TESCO warranty include:

 
  • A $50,000 warranty (up to $5,000 per item) for household appliances and electronic equipment that are damaged due to a failed TESCO surge
        protector;
  • 210 VAC, continuous 5 minute, temporary overvoltage clamping capacity.
  • Warranty covers repair or replacement of damaged item(s)
  • Covered items include:
    • Electromechanical equipment (motor driven) such as washers, dryers, dishwasher, sump pump, refrigerator, freezers, etc.
    • Electronic equipment such as television, VCR, computer, fax, stereo, printer, etc.
  • The warranty does not cover:
    • equipment used for commercial business
    • medical and life support equipment
    • data, records, files, programs stored in computers or office electronics
    • outdoor equipment such as outdoor lighting systems, wells, Jacuzzis and equipment in detached garages
    • damage caused by a direct or near-direct lightning strike or a tampered TESCO surge protector
    • surges that enter the home other than through the TESCO surge protectors

6. EU's Triple Surge Guard Service provides protection against the three most common entry points of surges: at the electrical (meter), telephone and cable/satellite TV entrances. Although rare, surges can enter your home through "backdoor entrances" such as outdoor Jacuzzis, sprinkler systems, security systems and other devices with wiring outside of your home. EU recommends that you use point-of-use surge protection (such as power strips) on sensitive electronic equipment. That protection coupled with EU's Triple Surge Guard comprehensive triple-point protection, will provide multiple layers of defense for your household investments and maximize your protection.

In the case of a claim or suspected claim, you agree to comply with the following process:

  • Review the Troubleshooting Guide.
  • Call EU at 800-681-3077 within 14 days of discovering or suspecting a surge-related problem.
  • EU will dispatch an inspector to investigate your equipment and claim. EU has the right to inspect the Triple Surge Guard equipment on your property and your
         appliances or household electronics/equipment should you notify EU that a power surge has passed through the Triple Surge Guard equipment and you
         believe your equipment has been damaged. You agree to make your house and property available to EU or its contractors for inspections, if necessary.
  • EU's inspector will leave a notice on your door as to the inspection's findings if you are not home.
  • If a failed TESCO surge protector is found, EU will replace it at no charge to you. EU will contact TESCO on your behalf to being processing your claim.
  • TESCO may contact you if additional information is necessary to complete your claim. You may be required, by TESCO, to provide a written estimate from an
         authorized technician regarding your household equipment's damage and repair costs.

7. EU shall have reasonable access to its Triple Surge Guard equipment, which EU owns and has installed at your electrical meter, phone, and cable boxes. If the Triple Surge Guard equipment is damaged, including without limitation, damage caused by your misuse or abuse of the equipment, or caused by removal, transfer, or tampering with it, or caused by vandalism, you are responsible to EU for the equipment. The agreement may be automatically canceled if the Triple Surge Guard equipment is damaged other than by a power surge passing through it, and EU will have no obligation to replace the Triple Surge Guard equipment.

8. If you violate any provision of the Agreement including the failure to make monthly payments, EU may cancel the Agreement immediately, and you will be liable to EU for all expenses associated in enforcing the Agreement, including attorneys fees, and other associated costs.

9. The Agreement shall be governed by the laws of the State of North Carolina. The Agreement may be modified only upon EU's prior written notice to you.

10. The Triple Surge Guard Service is a service provided by EnergyUnited to its residential customers only. Eligible customers must be homeowners of a single-family residence and have a current utilities account.
